CognexOS Terms of Service
These Terms of Service ("Terms") govern your access to and use of the CognexOS platform, website, and related services operated by Geliang Zhou ("CognexOS," "we," "our," or "us"). Please read these Terms carefully before using our services.
By accessing or using CognexOS, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you may not access or use our services.
1. Service Description
CognexOS is a platform that allows users to collect and save articles they enjoy, which are then converted into podcast format using artificial intelligence technology. Our Service enables you to:
- Save articles from across the web to your CognexOS account
- Access AI-generated audio versions of your saved articles
- Organize and manage your content collection
- Listen to your articles in podcast format across various devices
2. Account Registration
2.1 To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 You must notify us immediately of any unauthorized use of your account or any other breach of security.
3. User Content
3.1 By saving articles to CognexOS, you represent that you have the right to collect and save such content.
3.2 You retain any ownership rights you have in the articles you save. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of providing and improving our Service.
3.3 You are solely responsible for the content you save to CognexOS and the consequences of saving and publishing such content.
4. Intellectual Property Rights
4.1 All rights in the Service, including its content, features, functionality, software, and technology, are owned by Geliang Zhou or its licensors and protected by international intellectual property laws. Except as expressly stated in this Agreement, no rights or licenses are granted to you.
4.2 Usage of AI-generated content depends on your subscription:
- Free and Creator users may use content only for personal, non-commercial purposes. Commercial use, including publishing, promoting, monetizing, reproducing, distributing, or publicly displaying, is strictly prohibited.
- Pro, Business, and Enterprise users may use content for commercial purposes, subject to this Agreement and applicable laws.
You are solely responsible for ensuring that any AI-generated content you use complies with applicable laws and does not infringe third-party rights.
4.3 You retain ownership of uploaded content and grant Geliang Zhou a non-exclusive, worldwide, royalty-free license to use it to operate and promote the Service. Geliang Zhou may suspend or terminate accounts that infringe intellectual property rights or violate these Terms, at its discretion.
5. Acceptable Use
You agree not to use the Service to:
5.1 Violate any applicable laws or regulations.
5.2 Infringe upon the rights of others, including intellectual property rights.
5.3 Save or attempt to convert content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
5.4 Attempt to circumvent any technological measure implemented by Geliang Zhou to protect the Service.
5.5 Attempt to access, search, or meta-search the Service by any means other than through our published interfaces.
6. Privacy
Your privacy is important to us. Our Privacy Policy, which is incorporated into this Agreement by reference, explains how we collect, use, and disclose information about you.
7. Subscription and Payments
7.1 CognexOS may offer both free and paid subscription options. The features available to you will depend on your subscription type.
7.2 By subscribing to a paid plan, you agree to pay all fees in accordance with the pricing and payment terms presented to you at the time of purchase.
7.3 Subscriptions automatically renew unless canceled before the renewal date.
7.4 Refund Policy: You may request a full refund if your subscription is within 14 days of purchase and your credit usage during that period does not exceed 100 credits. Refunds are not available if either condition is not met. All refund requests must be submitted through CognexOS’s official support channels. We will review and process your request within 5 business days. CognexOS reserves the right to deny refunds or take further action in cases of suspected abusive or fraudulent refund behavior.
8. Termination
8.1 We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason.
8.2 Upon termination, your right to use the Service will immediately cease.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, Geliang Zhou shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
9.2 We do not guarantee that the AI-generated podcasts will be error-free, complete, or of a certain quality.
10. Modifications to the Service and Agreement
10.1 Geliang Zhou reserves the right to modify or discontinue the Service at any time without notice.
10.2 We may revise this Agreement from time to time. The most current version will always be posted on our website.
11. Governing Law
This Agreement shall be governed by the laws of HongKong, without regard to its conflict of law provisions.
